These Terms and Conditions (the “Terms”) govern your access to and use of the ascENDIT mobile application and its web-based administration portal (together, the “Service”), operated by Centro Capacitaciones END.IT SPA (“End It”, “we”, “our”), a company incorporated under the laws of Chile.

By downloading, installing, or using the Service in any way, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, you must stop using the Service immediately.

These Terms apply to:

• Individual users who create a personal account and subscribe directly; and
• Corporate clients — companies, institutions, or organisations that purchase access on behalf of their employees or students (“Administrators”) and the end users they enrol.

Where a Corporate Client has executed a separate enterprise agreement with End It, these Terms govern the relationship with individual end users. The enterprise agreement governs the relationship between End It and the Corporate Client on commercial matters. Nothing in a corporate agreement limits the rights that individual users have under these Terms.

ascENDIT is an AI-powered English language coaching app. Its main features include:

• Real-time pronunciation and speech feedback;
• Fluency, intonation, and vocabulary assessment;
• Individual progress tracking and performance reports;
• Preparation content for internationally recognised qualifications, including IELTS, TOEFL, TOEIC, Cambridge CAE and FCE, and the Duolingo English Test; and
• Industry-specific English modules for sectors including technology, finance, healthcare, mining, logistics, agriculture, tourism, manufacturing, and interview preparation.

Corporate Administrators access a separate web-based portal to manage enrolled users, review aggregate progress reports, and manage their organization’s account.

The Service is available worldwide except in Afghanistan, Belarus, Mainland China, and Russia, where access is blocked. End It may update this list with reasonable prior notice.

You must provide accurate, complete, and up-to-date information when registering. You are responsible for keeping your details current.

4.1 Creating an account

You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. If you suspect unauthorized access, notify us immediately at ask@endit.school.

4.2 Account security

Administrators may create and manage accounts for enrolled users within their organization. Administrators are responsible for ensuring the users they enroll comply with these Terms. End It is not responsible for how Administrators configure or restrict access within their organization’s account.

4.3 Corporate Administrators

The Service is provided solely for legitimate English language learning and professional development. You may not share your account with others or use the Service on someone else’s behalf without their knowledge.

4.4 Authorized use

Individual users who subscribe directly to the Service will be presented with the applicable fees, billing cycle, and payment terms at the time of purchase. All prices are stated inclusive or exclusive of applicable taxes as displayed. Subscriptions renew automatically unless cancelled before the renewal date.

5.1 Individual subscriptions

Users whose access is provided by a Corporate Client access the Service at no direct cost to them. The commercial terms between End It and the Corporate Client are set out in their separate enterprise agreement and are not disclosed here.

5.2 Corporate access

Individual subscribers may cancel at any time. Cancellation takes effect at the end of the current billing period; you will not be charged for the next period. End It does not offer refunds for unused portions of a subscription period except where required by applicable law or where End It is directly responsible for a material failure of the Service.

5.3 Cancellation and refunds

End It will give you at least 30 days’ notice of any price change before it applies to your subscription. If you do not agree to the new price, you may cancel before the change takes effect.

5.4 Changes to pricing

Our Privacy Policy, available at https://endit.school/, explains in detail what personal data we collect, how we use it, and your rights. The Privacy Policy forms part of these Terms.

Key commitments we make to you:

• Your data is never used to train, test, fine-tune, validate, evaluate, benchmark, or otherwise improve any shared AI or machine learning model. End It may engage carefully selected data processors and infrastructure providers strictly for the purpose of delivering the Service, subject to contractual obligations equivalent to those described in the Privacy Policy. 
• Your data is stored in a dedicated, isolated environment and is never shared with other clients or users.
• We use your data only to deliver the Service to you.
• You can request deletion of your data at any time by contacting ask@endit.school. We will confirm deletion in writing within 90 days.

Corporate Clients: your organization’s data is held in a logically separate environment. Your Administrator can request a full data export and certified deletion upon the end of your organization’s subscription.

The following notice is permanently displayed in the app:

“AI scoring is approximate and for practice only, not official IELTS/TOEFL bands. Scores may vary; use official exams for certification.”

All scores, assessments, and metrics generated by the Service are for educational practice only. They are not official certification results for any examination — including IELTS, TOEFL, TOEIC, Cambridge CAE/FCE, or the Duolingo English Test. Scores may vary between sessions due to background noise and other technical factors.

You must not use AI-generated scores as the sole or primary basis for academic applications, employment decisions, immigration applications, or any formal certification purpose. End It accepts no liability for any consequence of relying on AI-generated scores for such purposes.

When using the Service, you agree not to:

• Violate any applicable law or regulation;
• Attempt to reverse-engineer, copy, decompile, or extract the source code or AI systems underlying the Service;
• Attempt to access any other user’s account or data;
• Upload or transmit malicious code, viruses, or unlawful content;
• Present AI-generated practice scores as official examination results;
• Share your account or allow others to use it in your name; or
• Use the Service for any purpose other than English language learning.

Breach of these rules is a material breach of these Terms. End It may suspend or terminate your account immediately and without refund in such cases.

The Service, including its AI models, platform architecture, content libraries, exercises, and all underlying technology, belongs to End It and/or its licensors. Nothing in these Terms gives you any ownership over the Service or its underlying technology.

Content you create or upload remains yours. You grant End It a limited license to process and display it solely for the purpose of delivering the Service to you.

You must not reproduce, redistribute, or attempt to replicate any part of the Service’s proprietary content or technology.

The Service is suitable for teenagers and adults learning English. Users under 14 years of age must have the consent of a parent or legal guardian, who accepts these Terms on their behalf. If you are a Corporate Client enrolling user, you are responsible for ensuring that appropriate consents are in place for any user under 14.

If you believe a child under 14 has registered without proper consent, please contact ask@endit.school immediately.

Support is available by writing to ask@endit.school. We aim to respond to all queries. Corporate clients with an enterprise agreement benefit from the following service level targets:

Response times apply during standard business hours. End It will use reasonable efforts to provide a temporary workaround where a fix requires a software update. These targets do not apply where issues are caused by the user’s own systems, third-party infrastructure, or events outside our reasonable control.

End It provides the Service in good faith but does not guarantee it will be error-free or uninterrupted at all times.

To the fullest extent permitted by law, End It is not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of data, revenue, or business opportunity.

Nothing in these Terms limits End It’s liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded under Chilean law.

End It may update or change the Service over time to improve it. We will give you reasonable notice of any material changes.

We will notify you of material changes to these Terms by email and/or in-app notification at least 30 calendar days before they take effect. Continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.

You may stop using the Service and cancel your account at any time.

End It may suspend or terminate your access if you breach these Terms, if required to do so by law, or if we discontinue the Service, in each case with notice where reasonably practicable.

On termination, your right to use the Service ends. Sections 6 (your data and privacy), 7 (AI scores disclaimer), 9 (intellectual property), and 12 (limitation of liability) continue to apply after termination.

These Terms are governed by the laws of the Republic of Chile. Any dispute between you and End It arising out of or in connection with these Terms will be submitted to the competent courts of Santiago, Chile.

If you are located in the EEA, you also have the right to bring a complaint before your local data protection supervisory authority in relation to any data protection matter.

Separate enterprise agreements and data processing agreements may contain independent governing law and jurisdiction clauses applicable exclusively to those agreements.
